These Terms and Conditions (hereinafter "Terms") govern the use of services offered by Amazed S.r.l. through the amazed.tours Site, the Progressive Web Application (PWA) and future native versions for mobile devices.

1. Service provider information
These Terms and Conditions (hereinafter "Terms") govern the use of services offered by:

2. Definitions
- Service: the set of features offered by Amazed through the Site and the App, including game tours, cultural content and ancillary features.
- Site: the website accessible at amazed.tours and related subdomains.
- App: the Progressive Web Application (PWA) of Amazed and any future native version for mobile devices.
- Platform: the Site and the App, jointly.
- User: any natural person who accesses or uses the Platform.
- Account: the personal profile created by the User to access the Service.
- Tour: a stage-based game route purchasable by the User, playable in a specific city.
- GameMaster: the User who purchases a Tour in multi-device mode and who manages the game session and invitations to other participants.
- Pin Points: the internal virtual currency of the Platform, with no monetary value, described in art. 11.
- User Content: any content uploaded, submitted or published by the User through the Platform (e.g. "Pinny Postcards", reviews, surveys).
3. Technical requirements
The use of Amazed requires the user's device to meet the minimum technical requirements indicated in the following table. Compliance with these requirements is the responsibility of the user and is a necessary condition for the proper functioning of the service.
The Operator does not guarantee the functioning of the service on devices that do not meet these requirements and is not liable for malfunctions, errors or limitations arising from non-compliant technical configurations.

The user is required to keep their device and operating system updated to supported versions. The Operator reserves the right to periodically update the minimum technical requirements in line with technological evolution, providing communication to the user in the ways provided for in art. 13.
4. Subject matter and scope of application
These Terms apply to all Amazed services, and in particular:
- to browsing on the Site, subscription to the waitlist, completion of surveys and business contact requests;
- to registration, purchase and use of Tours through the App.
By using the Platform, the User declares that they have read, understood and fully accepted these Terms. In case of non-acceptance, the User is required not to use the Service.
5. Acceptance and changes to the terms
Acceptance of the Terms takes place through the use of the Platform and, where provided, by checking the appropriate box during registration or purchase.
Amazed reserves the right to modify these Terms at any time, for example for regulatory adjustments or evolution of the Service. Substantial changes will be communicated to the User with reasonable notice through the Platform and/or via email. Continued use of the Service after the entry into force of the changes constitutes acceptance thereof.
6. Registration, Account and minimum age
Some features require the creation of an Account. The User can register via email or through the supported Single Sign-On providers (Google, Apple and others indicated in the Platform).
The User undertakes to provide truthful, up-to-date and complete data, and to safeguard their credentials with diligence. The User is responsible for any activity carried out through their Account.
Minimum age. The Service is reserved for Users who have reached 16 (sixteen) years of age. Users under this age may use the Service exclusively under the supervision and with the consent of a parent or guardian, who assumes full responsibility for the related use.
Each Account is personal. The transfer or sharing of credentials with third parties is prohibited.
7. General Service Conditions
7.1 Nature of the service and use at own risk
Amazed provides exclusively a digital entertainment service, consisting of treasure hunts and self-guided urban exploration routes, usable through the application. The service is limited to proposing clues, riddles and playful indications; in no case does Amazed physically accompany, guide or supervise participants.
The participant acknowledges and accepts that the game takes place in real public spaces and involves their autonomous movement in the surrounding environment. The participant maintains at all times full and autonomous control of their movements and decisions and uses the service at their own exclusive risk, assuming full responsibility for their safety and security.
7.2 Obligations and responsibilities of the participant
In using the service, the participant undertakes to:
- comply with the law, road traffic rules and signage, as well as any regulations applicable to the places crossed;
- autonomously assess the safety of the routes and places before reaching them or interacting with them;
- not access dangerous, private, prohibited or otherwise not freely accessible areas;
- maintain constant attention to the surrounding environment, traffic and other people present;
- refrain from using the application while driving vehicles or in any situation that may compromise their safety or that of others.
The participant is solely responsible for their conduct during the game and for any damage caused to themselves, third parties or property.
7.3 Exclusion and limitation of Company liability
To the maximum extent permitted by applicable law, Amazed assumes no liability for damages, injuries, accidents or losses of any nature, suffered by the participant or third parties, or by things or property, arising from or otherwise connected to the game, the participant's movements, the conditions of the places crossed or the participant's interaction with the surrounding environment.
In particular, Amazed is not liable for the conditions, state of maintenance or safety of public spaces or third-party property in which the game takes place, being places not managed or controlled by the Company.
Nothing in these Conditions excludes or limits the liability of Amazed in cases where such exclusion or limitation is not permitted by applicable law, including cases of willful misconduct or gross negligence and cases of death or personal injury attributable to the Company's conduct.
7.4 Clues, routes and game content
The clues, riddles and indications provided through the application have exclusively playful and recreational purposes. Amazed does not guarantee that the suggested routes are risk-free nor that the indicated places are safe or accessible at all times. It is up to the participant to assess the opportunity and safety of reaching a certain place or performing a certain action suggested by the game.
7.5 Minors
The use of the service by minors is permitted exclusively under the supervision and responsibility of an adult. The parent or the person exercising parental responsibility assumes all responsibility for the participation of the minor and for their safety during the game.
7.6 Indemnity
The participant undertakes to hold Amazed, its directors, employees and collaborators harmless and indemnified from any claim, action, request for compensation, cost or expense (including legal fees) advanced by third parties and arising from the participant's violation of these Conditions or from their conduct during the game, to the extent that such indemnity is permitted by applicable law.
7.7 Acceptance
Access to and use of the service presuppose the full acceptance of these General Service Conditions. The participant is required to take note of them and expressly accept them before starting to play; in the absence of such acceptance, the use of the service is not permitted.
8. Description of the service
Amazed offers an urban "treasure hunt" experience that combines a stage-based game route with cultural content, audio guides and a virtual guide (the mascot "Pinny").
Completing each stage requires both solving a riddle and searching for clues in the real world, through the User's physical movement and geolocation features.
The Service is available in different game modes (e.g. single device and multi-device), as described from time to time in the specific Tour sheet.
Multi-device mode and role of the GameMaster. In modes involving multiple devices, the User who purchases the Tour takes on the role of GameMaster, manages invitations and team composition. Invited Users accept these Terms at the time of joining the session. The GameMaster does not act in the name or on behalf of Amazed.
Amazed may modify, suspend or discontinue, in whole or in part, the features of the Service, providing communication to the User where possible.
9. Prices, purchases and payments
The prices of Tours and other digital products are indicated in the Platform, inclusive of applicable taxes unless otherwise indicated.
Depending on the channel, payments are processed by third-party providers, including Stripe (for web purchases) and the in-app purchase systems of the stores (Apple App Store and Google Play) for native versions. The User is also subject to the conditions of the relevant payment provider.
Amazed does not retain complete payment card data, which is processed directly by the aforementioned providers.
Access to the purchased Tour is enabled after payment confirmation. In case of multi-device purchase, access may be subject to confirmation of all participants, according to what is indicated at the time of purchase.
Any discount codes, vouchers and promotions are subject to specific conditions of use and validity limits indicated at the time of issue.
10. Right of withdrawal and refunds
Users acting as consumers generally have the right to withdraw from distance contracts within 14 days, pursuant to the Consumer Code (Legislative Decree 206/2005).
Digital content — waiver of withdrawal. Tours and other digital products are provided as digital content not on a tangible medium. At the time of purchase, the User expressly consents to the immediate execution of the supply and acknowledges that, once enjoyment of the content has begun (e.g. starting the Tour or unlocking content), they lose the right of withdrawal pursuant to art. 59, paragraph 1, letter o) of the Consumer Code.
Refunds. Without prejudice to the above, Amazed evaluates possible refund requests in case of technical malfunctions attributable to the Platform that prevent the enjoyment of the Tour. Requests should be sent to hello@amazed.tours indicating the reference order.
10.1 Refund Policy
Preamble. This Refund Policy governs the conditions under which Amazed S.r.l., owner and operator of the Amazed application (hereinafter "the Company"), recognizes or excludes refunds, credits or compensation in relation to the purchase and enjoyment of tours offered through the application.
Tours constitute digital content usable through the application, without the need for any operator or external guide, and are configurable by the user within the parameters made available at the time of starting the game.
Except as expressly provided by the individual articles below, the payment made for the purchase of a tour or a single slot is considered final. The terms "GameMaster", "Participant", "slot", "tour" and "game" have the meaning attributed to them in the General Service Conditions.
Section I — Roles and Responsibilities
Art. 1 — GameMaster's responsibility in conducting the game
The start and conduct of the game are the exclusive responsibility of the GameMaster. It is up to the latter alone to determine the modalities, times and conditions of the game, including the choice of the start time, the game mode and the distribution of participants in teams.
The activation of the game is exclusively up to the GameMaster. Save in the case of proven platform malfunction, governed by Art. 8, any failure to activate the game is in no way attributable to the Company, but depends solely on the GameMaster, and does not entitle participants to any refund, credit or compensation. It is specified, on the other hand, that once started, the game cannot be canceled or interrupted by the GameMaster, being a characteristic of the platform.
The Company provides exclusively the technological platform that allows the organization and management of the game and assumes no responsibility regarding the decisions taken by the GameMaster in the exercise of such role. By way of example and not exhaustively, in the case of prepaid slots, the Company is not liable for any choices of the GameMaster relating to the game start time, including any start of the game at night hours or otherwise not liked by the participants, nor for choices relating to the game mode adopted or the team composition.
The GameMaster's decisions regarding the conduct of the game do not in any case entitle participants to refunds, credits or compensation.
Section II — Cases not entitled to refund
Art. 2 — Prepaid and unused slots
If the GameMaster makes the payment for a number of participants (for example 4) higher than the number of participants who actually confirm their participation (for example 2), the slots already purchased and not used do not entitle to any refund, total or partial.
The purchase of slots is considered final at the time of payment, regardless of the actual use thereof by the invited participants. No form of refund, credit or compensation is therefore provided for prepaid and unused slots.
Art. 3 — Participant withdrawal after individual payment
If the GameMaster invites participants and each of them adheres by autonomously paying for their slot, the amount paid is considered final and non-refundable from the moment of payment.
Should a participant decide not to take part in the game before the start of the same, the relevant fee already paid will not entitle to any refund, total or partial, nor any form of credit or compensation. The voluntary withdrawal of the participant, at any time prior to the start of the game, does not affect the finality of the payment made.
Art. 4 — Dissatisfaction relating to configuration and content
Any dissatisfaction of the participant regarding the configuration choices of the game left to the GameMaster, including the game mode, the start time and the game options that can be activated, does not entitle to any refund, credit or compensation, being decisions taken autonomously by the GameMaster in the exercise of their role.
Likewise, any dissatisfaction relating to the content of the tour, as prepared by the Company, including the route, the riddles, the difficulty and the duration, does not entitle to any refund, credit or compensation. The participant acknowledges that such elements are described before purchase and that the related purchase implies acceptance thereof.
Art. 5 — Tour expiration date
Each tour is subject to an expiration date, generally between one and two years, which is clearly indicated before the related purchase. It is the participant's responsibility to take note of such date before proceeding with the purchase.
Once the expiration date has passed, the tour will no longer be available or usable, and failure to use it within the indicated deadline will not entitle to any refund, total or partial, nor any form of credit or compensation.
Art. 6 — Technical device compatibility
The use of the tours requires a device, browser and data connection compliant with the minimum technical requirements indicated by the Company before purchase. It is the participant's responsibility to verify the compatibility of their device and technical environment before proceeding with the purchase.
The impossibility to enjoy, in whole or in part, the tour arising from the non-compliance of the participant's device, browser, operating system or connection with the indicated minimum requirements does not constitute a platform malfunction and does not entitle to any refund, credit or compensation.
The distinction from cases of malfunction attributable to the platform, governed by Art. 8, to which the related remedy applies, remains unaffected.
Art. 7 — Prohibition of transfer and assignment
Purchased tours, packages and individual slots are associated with the account of the participant who made the purchase and are not transferable, assignable or resalable to third parties, whether for free or for consideration.
The participant cannot transfer their already purchased slot to other users, nor transfer to third parties the right to enjoy the tour. Any unauthorized assignments or transfers are ineffective against the Company and do not entitle to any refund, credit or compensation.
Section III — Cases entitled to remedy or refund
Art. 8 — Platform technical malfunctions
If the participant cannot enjoy, in whole or in part, the tour or the game due to a proven technical malfunction attributable to the platform, the Company will, upon verification of the reported malfunction, restore access to the tour or, where this is not possible, recognize a credit of equal value or a refund of the amount paid.
This remedy applies exclusively to malfunctions attributable to the platform and does not apply in cases of non-use, withdrawal or impossibility of enjoyment arising from causes not attributable to the Company, including connection problems, devices or configurations of the participant, as well as the choices taken by the GameMaster in the exercise of their role.
Any malfunctions must be reported by the participant within 14 days via email to support@amazed.tours and accompanied by the elements useful to allow their verification.
Art. 9 — Duplicate or incorrect payments
In case of duplicate charge or charge for an incorrect amount, attributable to a technical error in the payment procedure, the participant is entitled to the refund of the sum unduly paid, upon verification of the occurrence.
The report must be made within 14 days of the charge via email to support@amazed.tours, providing the transaction details useful to allow verification. Once the merit of the report has been ascertained, the Company will refund the sum unduly received with the same payment instrument used for the purchase, unless otherwise agreed with the participant, within 14 days of verification.
It remains understood that this refund is limited to the part unduly paid due to the error or duplication and does not affect the validity and effectiveness of the payment correctly made for participation in the tour.
Art. 10 — Withdrawal of a tour from the catalog and service termination
The Company reserves the right to modify its catalog and to withdraw one or more tours from availability, as well as to discontinue, in whole or in part, the service offered through the application.
If the withdrawal of a tour or the termination of the service occurs when the participant has already purchased a tour and has not yet started to enjoy it, the Company will recognize, at its choice, the availability of an equivalent tour, a credit of equal value or a refund of the amount paid for the unused tour.
No refund, credit or compensation is due for tours already enjoyed, even partially, or for those whose expiration date has already elapsed at the time of withdrawal or termination.
Art. 11 — Refund modalities and timing
In cases where this Policy expressly provides for a refund, this will be made with the same payment instrument used for the purchase, unless otherwise agreed with the participant.
Requests and reports useful for obtaining a refund must be received within 14 days of the event that gives entitlement, via email to support@amazed.tours, accompanied by the elements necessary to allow verification. The Company, having ascertained the merit of the request, will refund within 14 days of the related verification.
Except as otherwise and expressly provided, any refunds recognized are limited to the amount actually paid by the participant and do not include additional sums for interest, indemnities or compensation.
For purchases made through stores (App Store, Google Play), refunds primarily follow the procedures of the relevant store.
11. Pin Points (virtual currency)
Pin Points are an internal virtual currency usable exclusively within the Platform (e.g. to unlock game hints).
Pin Points do not constitute electronic money, have no monetary value, are not convertible into money, are not refundable and are not transferable between Accounts.
Pin Points are linked to the User's Account. Amazed may modify the mechanisms of acquisition and use of Pin Points, as well as their game value, according to the evolution of the Service.
Accumulated Pin Points do not expire, except for termination of the Account pursuant to art. 14.
12. User-generated content
The Platform may allow the User to submit or publish content (e.g. "Pinny Postcards", reviews, survey responses).
The User warrants that they have all the necessary rights over the User Content and undertakes not to upload unlawful, offensive, defamatory content, or content that violates the rights of third parties or applicable regulations.
By submitting User Content, the User grants Amazed a non-exclusive, royalty-free, worldwide license to use, reproduce, publish and adapt such content for the purposes of the operation and promotion of the Service. The publication of any identifying elements (e.g. username) occurs only with the User's consent.
Amazed reserves the right, without being obliged to do so, to moderate, not publish or remove non-compliant User Content.
13. Intellectual property
The Platform and all related content — including trademarks, logos, the "Pinny" character, texts, audio, graphics, software and databases — are owned by Amazed or its licensors and are protected by intellectual property laws.
Amazed grants the User a personal, non-exclusive, non-transferable and revocable right of use, limited to the enjoyment of the Service according to these Terms. Any unauthorized reproduction, distribution, modification or commercial use is prohibited.
14. User conduct and safety during the game
The User undertakes to use the Service in compliance with the law, these Terms and the rights of third parties, and not to compromise its functioning or security.
Physical safety. The Service involves the User's movement in real public spaces. The User is solely responsible for their own safety and that of others during the game. In particular, the User undertakes to:
- pay constant attention to the surrounding environment and not to use the device while crossing the street or in situations of danger;
- comply with the Highway Code, signage, private property and restricted access areas;
- autonomously assess weather, traffic and safety conditions of the places.
Amazed is not responsible for injuries, damages or consequences arising from imprudent use of the Service or from failure to comply with the above indications.
15. Geolocation
The Service uses geolocation features to verify the User's proximity to Tour stages. Accuracy depends on the device and environmental conditions; Amazed does not guarantee the precision of positioning in all circumstances.
The processing of geolocation data is described in the Personal Data Processing Notice.
16. Suspension and termination of the Account
The User can terminate the use of the Service at any time and request the cancellation of their Account by writing to hello@amazed.tours.
Amazed may suspend or close the User's Account, with notice where possible, in case of violation of these Terms, fraudulent use of the Service or legal obligations.
The termination of the Account entails the loss of Pin Points and non-monetary ancillary content associated therewith, without prejudice to rights already accrued on Tours regularly purchased and not yet used.
17. Warranties and limitation of liability
Amazed undertakes to provide the Service with the required professional diligence, but does not guarantee that the Service will be free from interruptions or errors, nor the continuous availability of networks, devices or third-party services necessary for its operation.
To the extent permitted by law, and without prejudice to the mandatory rights of the consumer, Amazed is not liable for indirect, consequential or unforeseeable damages arising from the use or non-use of the Service. Nothing in these Terms limits the liability of Amazed in cases where this is not permitted by law (e.g. willful misconduct or gross negligence, personal injury).
Amazed is not liable for the content, products or services of third parties (e.g. partners, sponsors, payment providers, stores) possibly linked or integrated into the Platform.
18. Privacy
The processing of the User's personal data is governed by the Personal Data Processing Notice available at amazed.tours/privacy, an integral part of the relationship with the User. The User is invited to take note of it.
The Site does not use cookies or persistent identifiers on the User's device.
19. Applicable law and Jurisdiction
These Terms are governed by Italian law.
For any dispute with a User acting as a consumer, the court of the place of residence or domicile of the consumer, if located in Italy, has exclusive jurisdiction. For Users other than consumers, the court of Monza has exclusive jurisdiction.
The consumer User may also resort to the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.
